How to choose the right Portuguese lease template

Residential leases in Portugal are governed by the Civil Code and the New Urban Lease Regime (NRAU). Before choosing a template, decide three things:

  • Duration: a fixed term (with an end date and renewal rules) or an open-ended lease.
  • Type of use: permanent home, a room, a student, or a temporary lease (for example for work or study).
  • What is let: the whole home or only part of it, and whether subletting is allowed.

What a good lease agreement should include

  • Full identification of the landlord, the tenant and the property (land registry article and habitation licence).
  • The rent, how and when it is paid, and the rules for the annual update.
  • The term, renewal and how either party can oppose renewal or terminate.
  • The deposit, an inventory of contents (if furnished) and the condition of the property at handover.
  • Who pays for works, condominium fees and running costs.

After signing

A Portuguese residential lease must be in writing. The landlord must register it with the Tax Authority through the Portal das Finanças, pay stamp duty and issue electronic rent receipts.

Does a lease agreement have to be in writing?

Yes. Urban leases in Portugal must be made in writing, and the landlord has to register the lease with the Tax Authority through the Portal das Finanças.

What is the difference between a fixed-term and an open-ended lease?

A fixed-term lease has an end date and renews automatically unless one of the parties opposes renewal within the legal deadlines. An open-ended lease has no end date, and either party can end it on the terms and with the notice set by law.

Can I use the template to rent out a room?

Can the rent be updated every year?
